Dell Graham was gratified to receive a defense verdict for their client, a cardiologist, at the conclusion of a weeklong trial, August 24 to 28, in Ocala, Florida. The Ocala jury fairly quickly determined there was no negligence on the part of Dell Graham’s client in connection with a hospital discharge of an eighteen year old patient who suffered irreversible, and ultimately fatal, brain damage and multi-system organ failure as a consequence of a cardiac arrest two days following her discharge. The defense focused on the utter unforeseeability of the decedent’s cardiac arrest, in light of the patient’s clinical course and diagnostic findings from close cardiac monitoring during a five-day hospitalization.
