Florida Nursing Homes Authorized To Release Records On Deceased

Florida nursing homes need to be aware of a decision of the US Court of Appeals for the Eleventh Circuit which held that HIPAA preempts a Florida statute that authorizes nursing homes to release records of deceased residents to spouses, persons with a power of attorney, and others.  HIPAA only authorizes release of records of a decedent to the decedent’s personal representative.  That more restrictive HIPAA provision preempts Florida Statutes Section 400.145.  see Opis Management Resources LLC v. One of the exciting things that we’re doing in this firm, across all aspects, is expanding beyond our pure litigation background. We’re getting more into helping folks put together businesses or put together deals, avoiding problems in the first place. We’re helping school districts or other government agencies navigate federal requirements, even when there’s not a direct lawsuit on the horizon. It’s really rewarding to be in that advisory role, as opposed to just being in litigation mode all the time and helping people avoid problems that will keep them out of the courthouse.

Several states have experimented with various caps on pain and suffering type damages, and it remains to be seen what Florida’s going to do with that. They’ve had a cap system in place for several years, and I think that that has reduced the amount of litigation. There’s discussion about caps being imposed on the federal level as some part of grand bargain. That’s really tough to say at this point whether that’s actually going to happen, and, if so, what would the cap levels be. It’s a little too early to tell what’s going to happen with that.

We really enjoy working in this community, because you’ve got physicians operating at a very high level. We’ve got some top quality health care systems in North Central Florida. Certainly, when you have issues related to academic medicine, you know you’re getting some really good physicians involved in good care. It brings about very interesting situation. There are some of the sickest folks in the state come to this part of … or come to Gainesville for a cure, hopefully. Those can be very challenging cases for physicians to take on. They don’t always go well, and we’re there to help deal with those lawsuits that come about from that.

One of the first things I keep in mind is that, it can be the most trying time that a professional doctor or some health care provider has ever experienced. Their care is being directly called into question despite their best efforts for a patient. We understand that despite the best efforts, patients don’t always get well.

That’s a discussion that I usually have with the physician that I’m representing or the health care provider very early on in the case. We work through those issues so they can then focus on the medical facts and they can teach me so that I, in turn, can explain it to a jury or whoever might be looking at this case and understand how we, perhaps, had a bad outcome but that wasn’t at all related to any substandard care by the physician.

Things that we have here in Dell Graham is we’ve got close associations with education. In my family, I’ve got a number of teachers that I talk with about the issues they deal with on a day-to-day basis. One of our attorneys here, Susan Siegle, her first career was as a classroom teacher. She taught math to high school students before going to law school and now has sort of come full circle and represents school boards as their board attorney.
