Dell Graham attorneys David Delaney and Ryan Gilbert successfully defended a Florida public school district in Federal Court against a claim of Title IX retaliation. The lawsuit was brought by the parents of female high school athletes and students alleging that the school district attempted to punish various family members after allegations of Title IX violations were made. The school district denied the allegations and vigorously defended the claim through their attorneys. The Court noted that the case was highly unusual because no other case on record involved the family members of a student bringing a direct Title IX retaliation claim. Ultimately, the Court dismissed all of the claims brought by the family members in response to the school district’s motion for summary judgment. In addition, the Court awarded the District a portion of its court costs as the prevailing party.
